Webinar Working with Expert Witnesses Webinar (On-Demand)

Overview

Inspired by the Jackson reforms, in the current decade the civil courts have asserted greater control over the provision and presentation of expert evidence. Recent cases indicate that courts are using their powers to control expert evidence as the rule makers intended. This revised webinar will look at several of the key cases and address the challenges for solicitors in working with expert witnesses.

Topics and cases considered in the webinar will include:

  • Identifying a need for expert evidence and making the case for obtaining permission for it
  • Doing without expert evidence unsuccessfully (Avondale Exhibitions)
  • “Straying outside the expert’s area” (Wessely and Castle Trustee)
  • Or just remaining inside it (Moylett v Geldof)
  • The modification of a draft report and lawyers getting too close (BDW Trading)
  • What happens when you decide you need to replace one expert with another?
  • Is Wright v First Group an exception to the normal rule?
  • Trial procedure in handling expert evidence (Edwards Lifesciences v Boston Scientific)
  • Are all problems resolved by using 'hot-tubbing'?
