Local authority designation in care and supervision proceedings can be a controversial issue as well as an important practical one.
This webinar, with experienced barrister Ruth Cabeza, will examine the factors which determine designation in care proceedings, an issue which, if not properly understood, can distract the focus of a case away from the welfare of the child as competing local authorities try to avoid responsibility under care or supervision orders. In particular it will focus on:
• The different statutory test for designation under either a care or supervision order
• With regard to a care order the impact (if any) of Re A (Children)  UKSC 60 on the concept of 'ordinary residence', particularly in the context of a child born overseas by a parent who has fled the jurisdiction shortly before birth to avoid care proceedings;
• The impact of the changes to s.22 of the Children Act 1989 brought in by the Children and Families Act 2008 with regard to the definition of a looked after child for the purpose of the 'stop clock' provisions contained in s. 105(6) of the Children Act 1989.
