The Bribery Act 2010 (the Act) came into force in July 2011. At that time there was huge publicity about the alleged challenges which it was said the new legislation would pose for business and what firms would need to do to comply.
Some years later many commentators have been asking whether the Act was a paper tiger. A number of recent decisions have suggested this is not the case and that those responsible for enforcement now mean business.
This webinar will provide a refresher for solicitors who need to know about the Act whether in the context of practice management or of advising clients who may be affected by the rules and who need to ensure they are compliant. The session will consider how to structure an effective compliance programme and how to train staff. The much publicised corporate offence will be explored in the light of recent decisions along with the meaning and potential availability of the adequate procedures defence. The extra-jurisdictional nature of the legislation will also be discussed.
