Proprietary estoppel can be a useful remedy to achieve ‘justice’ for those clients who have acted on a promise to their detriment. Case law shows that it is not uncommon for an elderly or terminally ill person who requires substantial care at the end of life, to promise family or friends that if they look after them, they will be rewarded on that person’s death. If the person requiring support goes back on that promise or fails to execute a valid Will in the carer’s favour, proprietary estoppel may be the answer..
