Webinar New Code for Completion by Post - What now for conveyancers? Webinar (On-Demand)

This new webinar has been produced in conjunction with Bold Legal Group and features a discussion between Peter Dodge, Counsel for Mishcon de Reya in the Court of Appeal in Dreamvar and Lorraine Richardson, property solicitor and legal trainer. Peter and Lorraine discuss the decision and the implications for conveyancers of the new Code for Completion by Post.

Following the Court of Appeal decision in Dreamvar, the Law Society has produced its new Code for Completion by Post which conveyancers must use from 1 May 2019.  The Code sets out the responsibilities of conveyancers in relation to completion arrangements and updates the definition of ‘seller’ in the light of Dreamvar. Conveyancers will be concerned about the liability that they might take on in the event of fraud. CQS-accredited solicitors must use the Code, while its use is voluntary for non-CQS accredited firms. The Code can be varied by agreement – although whether this should be done by conveyancers due to the possible insurance consequences is another matter.

This webinar covers:

  • The view of Counsel who acted for Mishcon de Reya in the Court of Appeal
  • An outline of the Dreamvar decision
  • The changes that the new Code will introduce
  • What this might mean for conveyancers in practice
  • What steps can firms take to mitigate fraud risk?
