Applications to the Court of Protection regarding Deprivation of liberty have been increasing year on year, following the Cheshire West Judgment. Following the Court of Appeal judgment of SRK, deputies will be expected to alert their local authority about a possible deprivation of liberty even where the client is fully funding their own care, with no public body involvement. Does this also apply to attorneys or trustees and what should they do if the public body fails to act?.
It is vital that you keep up to date with the law in this area, to advise and act appropriately. Join our expert Caroline Bielanska as she takes you through a journey of how DoLS has evolved from the Cheshire West decision to more recent cases such as SRK v Staffordshire CC, R (Ferreira) v HM Senior Coroner for Inner South London, AP v Tameside MBC, Liverpool City Council & others v SSH, Secretary of State for Justice v MM; Welsh Ministers v PJ.
