Overview


The first deadline for gender pay reporting passed in April 2018, carrying in its train an avalanche of unfavourable publicity for companies which revealed a significant gender gap in the amount their employees were paid. There will also be consequences for those who failed to comply with the deadline.

This webinar deals with the duties on employers to publish information, outlining the relevant data, how to calculate it and the requirements for publication.

It then focuses on the enforcement mechanisms which the Equality and Human Rights Commission has announced that it will be using against those who have failed to comply with their obligations, including:

  • Investigation under s20 of the Equality Act 2006
  • Agreements under s23 of that Act
  • Orders for compliance from the County Court under s24
  • Unlawful Act notices under s22
  • Measures to deal with the public sector under ss31 and 32.

The webinar also examines, from a legal perspective, strategies to reduce the gender pay gap, including:

  • Positive action (sometimes misnamed “positive discrimination”)
  • Flexible working including putting senior roles on a part-time basis
  • Promoting access to childcare
  • Improving paternity leave conditions
  • Tackling prejudice and bias in recruitment, performance, evaluation and reward decisions.
