The list of advice which conveyancers are required to give clients purchasing a property is ever increasing. So much so that it is easy to gloss over obvious points to the detriment of the client and their legal adviser. Recent cases demonstrate that covenants are frequently considered by the courts as a well drafted, valid covenant can scupper the potential to develop the affected land. In addition, a case from 2014 illustrates the importance of ensuring that all of the due diligence bases are covered. The legal adviser did not advise on the terms of a covenant affecting the property.
