This qualification equips you with all the tools you will need to make sense of commercial property transactions in Scotland with a particular focus on commercial leasing. It offers you the chance to become familiar with the core elements in buying, selling and leasing commercial buildings and land.
An emphasis is placed on written assignments as a means of encouraging you to think through what you have read and gain confidence in answering questions before you come to the final written exam. An introductory module sets the scene by describing the operation of the commercial property market as part of the economy and the legal profession’s key role in allowing it to function.
The following modules go into the detail of the law but always at a level appropriate to the type of work a paralegal would expect to undertake. Modules cover examination of title (both Register of Sasines and Land Register), making successful applications to the Land Register for registrations and an explanation of the various searches and documentation to be expected in routine transactions. Later modules in the course cover the “Full Repairing and Insuring” commercial lease with extensive guidance on how to revise such a lease from both landlords’ and tenants’ viewpoints.
Missives, contractual remedies and Land and Buildings Transaction Tax are also covered, again with a focus on commercial transactions.
