This qualification examines the Scottish Civil Court system and explores core areas of Scottish civil law. This includes contract law - considering breach of contract; debt recovery - examining practical enforcement; and reparation - exploring duties of care.
You will gain insights into how civil court cases are prepared such as the gathering of evidence and drafting of court documents and how they are defended including the drafting of defences. You will become familiar with the various types of cases and discuss the differences in cases that can be brought in the Sheriff Court as well as the Court of Session including commercial and personal injury cases.
Assignments will include practical exercises in drafting paperwork used in court such as initial writs and defences which will help you gain confidence in turning theory into practice. You will gain knowledge of areas such as the law of evidence and how this works by increasing your understanding of caselaw and how to enforce court judgments such as using Sheriff Officers. You will become familiar with the system of expenses allowing you to maximise recovery expenses for your firm.
