This update will focus on
- the provisions of the Planning (Scotland) Act 2019 including its provisions about a new development planning system
- “Masterplan consent area schemes” (delivering regulatory approvals including planning permission) through the zoning of land
- changes to the development management and planning enforcement regimes
- controls over short-term lets (scheduled to come into operation on 1 April 2021)
- the measures which aim to improve planning authorities’ performance
- changes to planning obligations (including those introduced on 18 November 2020) and the establishment of an infrastructure levy payable to councils, and
- the implementation of the above provisions.
It will also address provisions which were not included in the Planning (Scotland) Act 2019 such as appeals against the grant of planning permission. The update will also provide:
- a commentary about any recent Scottish Government planning policy, guidance and advice
- a review of recent court decisions (from both north and south of the border)
- details about any noteworthy planning appeal decisions, and
- updates about related areas of law (including land law and compulsory purchase including the work of the Scottish Land Commission) and proposed land-use planning reforms elsewhere such as those proposed for England in the August 2020 White Paper “Planning for the Future”
Those attending this seminar will gain a better understanding of the legislative outcomes of the land-use planning reform review announced in 2015 and the issues relating to those outcomes; Scottish Government planning policy, guidance and advice, recent court decisions and Scottish Government planning appeal decisions.
