An Introduction to Alternative Dispute Resolution

There is increasing emphasis on diverting disputes from the court process. Going forward, the Scottish Government has committed to encouraging people to resolve disputes outside court. This 3 hour virtual classroom explores the various methods of solving a legal dispute without litigating, and to what extent ADR is provided for within the Scottish legal system.

Delegates attending this virtual classroom will:

examine the key elements of negotiation, mediation, arbitration, adjudication
look at the Arbitration (Scotland) Act 2010 & Mediation (Scotland) Bill
consider how ADR fits within the Scottish legal system
explore ADR in the context of civil litigation: what do the procedural rules say?
