There is increasing emphasis on diverting disputes from the court process. Going forward, the Scottish Government has committed to encouraging people to resolve disputes outside court. This 3 hour virtual classroom explores the various methods of solving a legal dispute without litigating, and to what extent ADR is provided for within the Scottish legal system.
Delegates attending this virtual classroom will:
- examine the key elements of negotiation, mediation, arbitration, adjudication
- look at the Arbitration (Scotland) Act 2010 & Mediation (Scotland) Bill
- consider how ADR fits within the Scottish legal system
- explore ADR in the context of civil litigation: what do the procedural rules say?
