New Code for Completion by Post - What now for conveyancers?

Peter and Lorraine discuss the decision and the implications for conveyancers of the new Code for Completion by Post. Following the Court of Appeal decision in Dreamvar, the Law Society has produced its new Code for Completion by Post which conveyancers must use from 1 May 2019. The Code sets out the responsibilities of conveyancers in relation to completion arrangements and updates the definition of ‘seller’ in the light of Dreamvar. Conveyancers will be concerned about the liability that they might take on in the event of fraud. CQS-accredited solicitors must use the Code, while its use is voluntary for non-CQS accredited firms. The Code can be varied by agreement – although whether this should be done by conveyancers due to the possible insurance consequences is another matter.
