Course Pensions Law and Brexit: Implications and Actions


In the last two decades, UK pension schemes have experienced a significant amount of regulatory change. Much of this change has come from the EU and has been embedded in UK legislation. In the medium to long term, Brexit is likely to affect UK pension scheme law and regulation. This course will explore the following issues and more:

  • Discrimination law – particularly the areas of sex and age discrimination. The UK will need to respond to any further developments in EU discrimination law to remain an effective trading partner for the EU.
  • TUPE – the application of TUPE to pension benefits is particularly complex, following two decisions from the ECJ. Brexit may provide an opportunity for the UK courts to clarify this area.
  • Funding and member protection – the current scheme-funding regime is heavily influenced by the EU. Brexit will enable the government to bring about changes to this area.
  • Pension scheme funding strategy – the impact of Brexit on interest rates, the strength of sterling, stock market performance and gilt rates will all have implications for scheme investments and scheme funding.
  • Qualifying Recognised Overseas Pension Schemes – tax exempt status of overseas pension transfers post-Brexit
