Are you having re-accreditation nightmares?

Be prepared for ethical questions by using CLT’s Caseworkers’ Ethics Training Pack to ensure you are up to date.

Professional Ethics forms an integral part of the assessments for both the Immigration and Asylum Accreditation Scheme (IAAS) for accreditation and re-accreditation. The Law Society’s standards for both caseworkers and senior caseworkers require ethics to be tested. There is no individual ethics question on the paper it is pervasive throughout the examination questions.

Don’t fail because of a Gross Professional Error


The examination regulations provide that if a candidate is found to have suggested a course of action in his/her examination answer which is found by the Assessment Board to be a Gross Professional Error (GPE), then the candidate’s assessment result will be a fail regardless of whether the candidate has achieved a result of 50% or over.

In addition to an automatic fail, failure due to a GPE may mean a candidate is not allowed to resit the assessment and may mean that the candidate has to take all of the accreditation examinations to retain membership of the Law Society’s IAAS.

What’s tested?

Caseworkers must have knowledge of the provisions of the Solicitors’ Code of Conduct 2007 in relation to conflict of interests, confidentiality, core duties, providing a proper standard of work and the duty to the Court.

Senior caseworkers must have:
  • understanding of the professional and ethical rules relating to confidentiality and conflicts, the independence of the legal representative, their duty to act in the best interests of the client, to maintain a proper standard of work and their duty to the court
  • an ability to instruct and work with other professionals
  • an understanding of and ability to comply with the relevant professional obligations and duties
  • understanding of guidance issued by the Law Society and others in relation to duties to clients, the courts and the Home Office or other official bodies
  • ability to identify issues or events that give rise to a conflict of interest and the ability to act appropriately

What’s in the Ethics Training Pack?

To help caseworkers prepare for the re-accreditation assessments, CLT has prepared a video lecture available on-line via CLT’s website www.clt.co.uk on ethical issues for immigration practitioners. The hour long video details the relevant rules in the Solicitors’ Code of Conduct 2007 and applies the rules to some typical situations.

The pack also has online multiple choice questions with immediate results and feedback which will help candidates to assess their ethics knowledge.
