Agricultural Law: Refresher and Update - 3 hours

This field of practice can change rapidly and anyone who advises farmers and landowners will benefit from this review and update. Recent updates to NVZ management rules have an impact on livestock farmers. New proposals in the name of localism will affect all landowners as will new policies for the natural environment.

In Europe, the CAP is undergoing significant reform and changes to the EU budget will affect farm receipts and may require changes in approach. Recent cases have clarified some questions relating to the Single Payment Scheme and recent Agricultural Land Tribunal decisions will have consequences for tenanted land.

Amongst other things this course will cover:

  • Common Agricultural Policy after the Health Check: Single Payment Scheme, cross compliance changes and effects on document drafting
  • Current state of CAP reform discussions and proposed timetable
  • Changes to tenancies under the Agricultural Holdings Act 1986 and the Agricultural Tenancies Act 1995
  • New provisions for flood and coastal erosion risk management
  • Politico-legal issues looking forward: nitrate pollution, natural environment, water resource management etc
  • Case law: Single Payment Scheme; agricultural tenancies; planning and agricultural occupancy etc.
