''Everything today is image''. Designs, whether in graphics or in packaging, play a vital role in marketing and consumer choice. However, confusion continues to exist between the protection afforded by registered design law, the design right and copyright.
Now that the Registered Designs Act has been amended by the Registered Design Regulations 2001, and Community registered designs and Community unregistered design right have arrived on the scene, it is appropriate to consider:
- The benefits of registration under the Registration Designs Act 1949 (as amended) and the Community designs regulation
- The interrelationship with design right for purely functional items
- The underlying nature of copyright in designs and the limitations on enforcement imposed by s.51 Copyright Designs and Patents Act 1988
- The strengths and weaknesses of protection under the two unregistered design rights
- Conflicting ownership rights
The Course will incorporate short case studies to illustrate and consolidate the above points.
