  Drafting Licensing Act 2003 Conditions

In reaching decisions on licence applications, local authorities often have to address their mind to drafting licence conditions. This can be a challenging experience, especially when considering Licensing Act 2003 applications, as there are strict requirements on what conditions can be attached. Inadequate drafting can often result in expensive appeals that could otherwise be avoided.

This course will be of assistance to both local authority councillors and officers from responsible authorities in preparing conditions that are necessary, reasonable and enforceable. Specifically, we will look at the statutory provisions, the Secretary of State's Guidance and case law that has developed since the Act came into force. There will be practical opportunities to try and draft conditions in a relaxed atmosphere as well as an opportunity to ask questions. Examples of real-life conditions will be used to illustrate some of the pitfalls.


Jon Payne before being called to the Bar, Jon was an Environment and Licensing Manager for a local authority. Over his 18 years working in local government, he has been involved in a wide variety of enforcement matters. He currently works as a solicitor and non-practising Barrister for Horsey Lightly Fynn Solicitors.
