PRs are finding themselves increasingly embroiled in litigation, whether by or against third parties or to resolve disputes between beneficiaries. This course provides a detailed and up to date examination of the many and varied contentious matters PRs commonly face during the course of estate administration including third party and property claims aimed at resolving what property is in the estate for distribution and determining any equitable or other claims individuals may bring against the estate, claims under the Inheritance (Provision for Family and Dependents) Act 1975, litigation necessary for resolving uncertainties in the administration and distribution of estates and hostile claims against PRs. This course is suitable both for private client practitioners who regularly advise individuals before death and PRs after death, and also for general litigators who may get referred such matters from their firm's private client department and who need to build expertise in this area.
The course will cover:
- s14 TLATA claims and constructive trust claims over land
- Proprietary estoppel
- Claims under the Inheritance (Provision for Family and Dependants) Act 1975
