White Collar Crime 2012 - Criminal Practice and Pitfalls
horizontal rule

  • * Advanced/Update/Intermediate
The upsurge in regulatory offences is resulting in a marked increase in arrests and interviews of those who are often least able to cope with it. When advising these clients the pressure is on. This course will assist regulatory and commercial lawyers when a client calls in panic after being arrested; "invited for interview"; or when confronted by officers with a warrant.

From alleged regulatory breaches to deaths in the workplace and beyond, this is when the essential skills of the criminal lawyer need to be coupled with the specialist knowledge of the practitioner's own discipline. The course will include:

  • * To co-operate or not? - Striking the balances
  • Compulsory interviews - protecting their status
  • Disclosure - Tips and tactics to protect the client
  • Confidentiality and legal privilege - The essentials
  • Dealing with investigators - understanding the process
  • Advising clients - Ensuring best practice
  • The “right to silence” – What it means in practice
  • Sentencing - Does it really do what they say?
  • Managing the client in detention and at interview
  • Charge, bail and beyond - Litigation management
