This is a course that has been specifically designed to cover the essential elements of highway law. Understanding what a highway actually is at both common and statutory law. The course will focus on such matters as the creation of highways and dedication and adoption as well as issues arising out of the use of the highway. Duties of the highway authority and discretionary powers will be considered. The topics covered are designed to give a broad introduction to the issues which are faced by highway authorities and include the following:
1. Foundation of Highway Law - Issues associated with the creation of highways, ownership and boundaries.
2. Creation and Adoption of Highways - Consideration of the advance payments and private street works codes.
3. Stopping Up and Diversion of Highways - Crossing highway and planning act powers.
4. Protection of Public Rights of Way Highway - Duty under Statute and Common Law.
5. Highway Agreements - agreements with developers and other highway authorities
6. Transport and Works Act powers - alternative public transport systems
7. New Roads and Street Works - Powers of the Street Works Authority and Statutory Undertakers
8. Maintenance of Highways - the responsibility of the highway authority
9. Improvement of Highways - Discretionary powers
10. Compensation for Highway Works - the statutory requirements
11. Trading on the highway - The legal provisions concerning street trading designations and street trading consents.
12. Traffic Regulation Orders - the powers of the traffic authority
