Course Overview Seminar

This course looks at the particular requirements which apply to land transactions of charities, whether on acquisition, mortgage or disposal. There are a range of statutory obligations and many other possible constraints. It is suitable for all who advise charities or the parties who deal with them. The course covers the Charities Acts of 1993 and 2006 and the new consolidating legislation in the Charities Act 2011.

The course will cover:

  • Charities - introduction for Property lawyers – charitable purposes and public benefit
- Types and forms of Charities

- Trustees – duties of trustees, importance of property as a Charity’s asset

  • Disposals by a charity and ss 117 – 121 Charities Act 2011
  • Mortgages by a charity and ss 55,124 - 126 Charities Act 2011
  • Acquisitions by a charity
  • Commercial leases generally and specific issues for charities
  • Official Custodian for Charities – s122 Certificates
- Execution of deeds

  • Some common issues including title issues, SDLT, Community Infrastructure Levy, renewable energy schemes and the review of the 2006 Act
