This course looks at the particular requirements which apply to land transactions of charities, whether on acquisition, mortgage or disposal. There are a range of statutory obligations and many other possible constraints. It is suitable for all who advise charities or the parties who deal with them. The changes made by the Charities Act 1996 are covered.

The course will cover:

  • * Charities - introduction for Property lawyers – charitable purposes and public benefit
- Types and forms of Charities

- Trustees – duties of trustees, importance of property

  • * Disposals by a charity and s36 Charities Act 1993
  • Mortgages by a charity and s38 Charities Act 1993
  • Acquisitions by a charity
  • Commercial leases generally and specific issues for charities, business rates and VAT (briefly)
  • Official Custodian for Charities - s36 and s38 statements and s37 Certificates
- Execution of deeds
  • * Some common issues
