Course Overview Seminar

This course is the second day of a series designed for fee earners with little or no knowledge of Commercial Property Law. The days can be attended separately or as a series. This comprehensive programme aims to provide a firm grounding in the essential law and practice area.

Day two of the course will focus on:

  • The form and main contents of a typical business lease (by reference to a specimen lease)
  • Negotiating a commercial lease - the main points to watch out for
- Premises

- Insurance

- Repairing obligations & schedules of condition

- Rent review

- Service Charges

- User clauses

- Break rights

- Signs, parking, services, shared facilities

  • The Code of Practice for Commercial Leases
  • Statutory protection for business tenants; Landlord & Tenant Act 1954
- Protection given

- Contracting out

- Procedures for ending and renewing business leases

- Drafting and serving L & T Act 1954 s25 and s26 notices

- Compensation for the tenant

  • Assignment of commercial leases
- The need for the landlord's consent - ss19 (1)(a) and 19 (1A) L & T Act 1927

- Landlord's duty to consent under s 1 L & T Act 1988

- License to assign

- Authorised guarantee agreements

  • "Running" commercial leases
  • Variations, rent reviews, underlettings, alterations, repairs etc
  • SDLT - Many unhappy returns? Does the client understand the continuing need to submit returns? Client case considerations
