This course will assist you in dealing with the particular problems emanating from the breakdown of the cohabiting unmarried family.


There will be a particular emphasis on property issues in cohabitation in relation to establishing a beneficial interest, the extent of that interest and the court procedures involved, enabling practitioners to advise more confidently in this complex area which is outside the ‘comfort zone’ of many practitioners.


The course covers the following areas:-


  • Ownership of the Home including conveyancing and other practical aspects
  • Implied, Resulting and Constructive Trusts and Proprietary Estoppel
  • The implications of Stack V Dowden and Kernott v Jones
  • The quantification of beneficial ownership, equitable accounting and procedural matters if proceedings are necessary
  • Ownership of Personal Property including cars, furniture and bank accounts
  • Applications under Sch 1 of the Children Act 1989
  • Living Together Agreements
  • Domestic Abuse and Occupation of the Home (Part IV of the Family Law Act 1996)
  • Disputes about children (Children Act 1989)
  • CSA
