Personal injury practitioners face multiple challenges: the relevant law and practice is developing at an ever increasing speed, the funding for claimants remains difficult, and the recoverable costs are under attack.
The course is both topical and relevant for the personal injury lawyer who appreciates that catastrophic injury litigation is not simply the basic formula with big numbers but a wholly more demanding course of litigation.
The course is designed for claimant's solicitors who wish to stay on top of the law and to raise their game. Knowledge of funding issues and relevant RSC procedure is assumed.
Topics to be covered:
- Awards for future loss and damage - lump sum or periodical payments - indexation - the evolving new law
- Defeating the defendant's argument for deduction from the compensation award - the local authority's actual or potential direct payments based on assessed need - the new law
- Loss of earnings - the Ogden 6th edition - explanatory notes - the new methodology
- The Mental Capacity Act 2005: the new practice and the implications for personal injury litigation
- The choice and management of the expert witnesses - the limits of acceptable practice
