This Act represents the most significant change in the regeneration and supply of homes, and the regulation of housing associations for possibly twenty years. The changes are radical and property practitioners need to be abreast of them.

  • English Partnerships and the Housing Corporation are to be abolished
  • They will be replaced by a new Homes and Communities Agency (HCA) and Tenant Services Authority (TSA) with implications for increasing centralisation of the future functions of both new bodies
  • The HCA will have wide borrowing powers (up to £3bn) and can buy and sell land. It will have powers to override a planning authority and also has compulsory purchase powers
  • The TSA will be the new regulator of all social housing and will set standards which registered providers will be forced to comply with
  • Matters which the TSA will regulate include quality houses, terms of tenancy, levels of rent and estate management
  • Sustainability certificates and changes to "Right to Buy"
The course will examine these and other key provisions in the 2008 Act covering a range of other housing issues and provide background to the political drivers for the legislation.
