The law relating to criminal procedure and sentencing was changed dramatically by the Criminal Justice Act 2003. Many of the major provisions are now in force and new legislation has already been rushed through to amend some of them. A series of recent judgements in the appeal courts have also had a significant effect on sentencing. In addition, implementation of important provisions of the Criminal Justice and Immigration Act 2008 has begun. This course will update delegates making use of practical examples and case studies.

Topics covered will include:

  • Mode of trial and the new allocation procedure
  • Bail: new procedures and presumptions
  • Expert evidence: the new rules
  • Disclosure: the changes to the duties of prosecution and defence
  • Retrials and the double jeopardy rule
  • Prosecution appeals from the judge's rulings
  • Trial on indictment by judge alone
  • Sentencing: covering previous convictions, 'custody minus' and the suspended sentence, 'custody plus', dangerous offenders and the powers of the magistrates
