In July 2007 the Mental Health Act 2007 introduced radical amendments to the Mental Health Act 1983, the bulk of which is operational from November 3rd 2008. These changes have had a direct effect upon professional practice making the individual more accountable for individual decisions and actions made under mental health law.
Six months after enactment, this seminar looks at the effects these changes have had and seeks to distinguish the facts from the myths.
In particular it looks at specific issues that caused consternation prior to enactment. In so doing it moves the interpretation of these issues away from mere theoretical speculation and towards the realm of identified practice.
This seminar will review the amendments to the Mental Health Act 1983 both in the light of previous practice and in their working relationships with associated litigation such as the Human Rights Act 1998, the Mental Capacity Act 2005 and the Domestic, Violence, Crimes and Victims Act 2004.
The speaker brings a clinical perspective rather than a purely legal or administrative one.
