This course provides an overview of the implications for local authorities and PCTs of the new "Bournewood" provisions introduced into the Mental Capacity Act 2005 by the Mental Health Act 2007. The course will cover:
- When will it be lawful to deprive a person lacking capacity of their liberty?
- What deprivation of liberty is...and what it is not
- The factors to consider when determining the important distinction between restriction and deprivation of liberty
- Consider whether the Deprivation of Liberty safeguards will indeed safeguard and reduce the number of vulnerable people deprived of their liberty in hospitals and care homes
- How will these provisions affect assessment, care planning and monitoring?
- What assessments will need to be done to ensure deprivation of liberty is lawful?
- Explore the process of authorisation, review and appeal
- The role of the donee of a Lasting Power of Attorney or Deputy in decision making
- What should we be doing about keeping people safe in the meantime before the provisions come into effect?
