Affordable Housing schemes vary greatly in nature and are an important sector of the Conveyancing market. There are vital differences between these transactions and "standard conveyancing" of which all practitioners should be aware. This course is designed to offer a practical guide for practitioners acting for individuals buying and selling Affordable Housing.

The course will cover:

  • * Introduction to Shared Ownership: the role of the Homes and Community Agency and Registered Providers of Social Housing following The Housing & Regeneration Act 2008 and the closure of the Tenant Services Authority ; an overview of the different types of Shared Ownership scheme including New Build Homebuy, Protected Area schemes, Social Homebuy, DIYSO, and Rent to Homebuy
  • Shared Ownership Conveyancing: Overview of the Model Lease (highlighting the revisions introduced in 2010); restrictions on assignment, practical issues in respect of alienation, service charges, rent review, mortgagee protection provisions, staircasing and pre-emption rights, CML requirements. Licence and consent requirements, repairing and insurance obligations, restrictions on extension of leases, variation of leases, Land Registry issues, nomination fees, possible consequences of rent arrears
  • SDLT: on the grant of a lease, Market Value Election - what is it & how it is made and recorded; problem areas, assignment; the effect of staircasing and calculating the tax payable, completing the SDLT return
  • Shared Equity Loans: an overview of the current government funded schemes, practical issues affecting Homebuy Direct and other schemes to include restrictions on redemption, further advances and the impact of improvements
  • Staircasing: What is staircasing? What are the limitations, how is it exercised and documented? SDLT - when is it payable and how is it calculated? Downward staircasing
