This course provides a general update of key developments in law and practice for local authorities, including:
- TUPE – The 2006 Regulations, update on the Cabinet Office Guidance and Code on Workforce matters, case law on secondments and agency workers, Discrimination/HR/Equalities issues and local authorities’ new duties and responsibilities
- The Public Procurement Regime – 2006 regulations and recent case law
- Partnerships – Especially Local Strategic Partnerships, their powers and limitations/partnerships in general including governance, Social Care, Health, Regeneration and Care Trusts
- Code of conduct for members, misconduct, standards board – recent developments and what behaviour is and what is not covered by the Code
- Bias and Apparent Bias – recent case law, following due process and ensuring that members understand their responsibilities
- Freedom of Information Act and a review of how the act has been working in practice
- Update on the Human Rights Act, including the interconnection of adverse possession, Land Registration Act and Human Rights. What is a public authority, (see Aston Cantlow) and the latest developments in social care case law
