This course will look at the different ways that intellectual property rights can be infringed including primary and secondary infringement, in relation to copyright, design right, trade marks (including domain names) database right and patents. It will consider how to effectively manage infringement situations and what options are available to stop infringers including:
- How to avoid being sued in return (groundless threats)
- Litigation in the English courts v Arbitration v Mediation
- Domain name dispute resolution procedures
- Who to sue (companies and individual directors)
- Jurisdiction
- Civil remedies (damages and injunctions) and criminal liability
- Trading standards authorities and criminal proceedings
