Normally when exchange takes place most of the problems are over. When times are difficult practitioners increasingly have to deal with the situation where, after exchange, one party wants to back out or, for some other reason, things go wrong. This course considers how to avoid problems and, when they do occur, how to resolve them. It also considers the practical, legal and drafting issues in relation to the following areas:
- Contractual deposits - when things go wrong
- Problems between exchange and completion
- Vacant possession and the undisclosed occupier
- Unpaid purchase money and completion notices
- Failure to compete - what happens next?
