The New Roads and Street Works Act 1991 (NRASWA) reformed legislation relating to the utilities street works by the creation of a completely new procedural code for carrying out street works. The Street Works (Registers, Notices, Directions and Designations (England) Regulations 2007 came into force on the 1st April 2008: are you up to date with the changes?
This course has been designed for local authority lawyers, NRASWA officers and other officers who deal with highway matters including traffic regulation. It will focus on the duties and responsibilities of the street works authority in matters such as the co-ordination of works and the duty of undertakers to co-operate and will include:
- The Basics - understanding what is meant by street works, road works, undertakers and other relevant statutory words and phrases
- The General Duties - the responsibilities of the street authority and the undertakers
- Notices - what information should be included in advance notices, notice of starting date and emergency notices
- Licences - the provisions for inclusion in street works licence
- Streets subject to special controls - when to designate protected streets, streets with special engineering difficulties and traffic sensitive streets and their effect
- General Requirements as to Execution of Street Works - safety measures, delays and obstructions
- Temporary Traffic Regulation Orders - orders and notices that are considered necessary for the control of traffic in connection with the undertaking of street and road works
- Liability for Costs and Charges - who pays the cost of matters such as temporary traffic regulation, use of alternative route and making good long term damage
- Duties and Liabilities of Undertakers with respect to Apparatus - duties in connection with the location and maintenance of apparatus
- The Traffic Management Act 2004 and the 2007 Regulations - considering the effect of amendments made to NRASWA and the governing regulations
