The law relating to prize promotions in advertising and marketing changed drastically on 1st September 2007 when the relevant provisions of the Gambling Act 2005 came into force. Whilst the new law brought in significant relaxations in relation to product purchases associated with prize promotions, it also introduced many uncertainties, for example, the position of promotions run over premium rate lines. It is far from clear just which types of prizes are covered by the new law. On 6th April 2008, the Unfair Commercial Practices Directive came into force, and this places further restraints on prize promotions - indeed, it might well make such promotions completely illegal. This seminar will bring delegates completely up to date on the difficulties now existing in this important area of the law, and will cover:
- The difference between the old law, represented by the Lotteries and Amusements Act 1976 and the new law under the Gambling Act 2005
- The difference between simple and complex lotteries, and how the new law governs promotions where prizes are won by chance
- What constitutes skills under the new law
- Whether all forms of prizes fall within the new law
- The new rules as to what constitutes free entry into a promotion; the special problems caused by premium rate lines; whether winners can be asked to pay to collect prizes
- The extent to which prize promotions are affected by the Unfair Commercial Practices Directive
