Changes to the decriminalised parking system came into effect on the 31st March this year and all civil enforcement authorities will need to ensure that they are in full compliance with the new regime. This course is designed to meet the specific needs of all officers involved with civil parking enforcement, and will focus on the relevant regulations and guidance, appropriate documentation including TRO's and PCN's, as well as issues that are likely to be relevant to representations and appeals. The topics covered will include:
- The enabling legislation - the legal framework for traffic regulation and the decriminalised parking regime
- Are your TRO's enforceable - essential elements of Traffic Regulation and associated Orders and the relevance of traffic signs
- Part 6 of the Traffic Management Act 2004
- Objectives of Civil Parking Enforcement - management of traffic network and improvement of road safety, environment and the quality and accessibility of public transport etc
- Setting Charges - adoption of level of charges associated with level of publicly acceptability and compliance
- Communications and consultations - making road users aware of local authority motives in relation to parking enforcement
- Appraisals - the effectiveness of the Scheme
- Civil Enforcement Officers - duties and related activities
- Drafting relevant documentation - Orders, Notices and PCN's
- Challenges/representations and appeals - internal procedures and the Traffic Penalty Tribunal
- Reporting - Section 55 Road Traffic Act 1984
- Experience of decriminalised parking enforcement - pitfalls, teething problems and reviews - a local authority's perspective of the system
- Case studies - An opportunity to consider and discuss issues that are frequently raised in relation to representations and appeals
