This course comprises an in depth study of the legal and practical issues involved in dealing with speeding allegations including:

  • The notice of intended prosecution and request for driver details
  • The summons and whether the prosecution is brought under the correct legislation
  • Determining the appropriate plea
  • In the event of a not guilty plea based upon a disputed speed reading - the disclosure which will be required from the police/Crown
  • The procedure to be adopted to compel disclosure by court order if disclosure is not forthcoming
  • Guidance as to the issues to pursue in cross examination of the operator of the speed measuring device at trial
  • Assessing the material that will be required if the client is seeking to challenge the enforceability of a speed limit due to inadequate signing
  • An appraisal of the applicable law in regard to the signing of camera enforcement sites
  • Sentencing considerations in regard to speeding offences including mitigating factors and the concept of "exceptional hardship"
