  10 Most Tricky Problems in Employment Law

This practical course reviews recent developments in Employment law in areas that most often arise in daily practice using a case study and interactive format. As well as recent statutory developments, some of the case studies will focus upon the safest strategies to end the employment relationship including redundancy and unfair dismissal and the procedures for disciplinary hearings. Agency, discrimination and TUPE problems will also be covered.


  • * Employment status - looking at the definition of employment status and the thorny issues surrounding the rights of employees, workers and the self employed
  • Agency workers - exploring agency contractual arrangements and the Agency Workers Regulations
  • Legal representation at disciplinary hearings – the right to legal representation and how to manage these requests from employees
  • Redundancy - problematic issues particularly collective consultation and protective awards
  • Covenants - examining recent case law and guidelines on whether a covenant is reasonable and enforceable
  • Annual leave - considering recent case law and how the courts are interpreting Stringer v H M Revenues and Customs and the Pereda decisions. Focusing on issues of accrual of annual leave whilst on long term sick and how to manage employees who become sick before/during a holiday.
  • Ending the employment relationship – including having difficult “without prejudice” conversations and issues relating to compromise agreements
  • Discrimination – religion or belief. Review of case law and the guidelines from the ECHR
  • Age discrimination – Retirement, interpreting case law and other problematic areas for practitioners
  • TUPE – considering service provision changes, insolvency, contractual changes as a result of a relevant transfer and issues of establishing an ETO reason

Kate Shepherd is a charismatic employment lawyer and principal of her own employment law consultancy business – Kate Shepherd Associates. Previously, Kate practised employment law in the Midlands and now advises a wide array of employers from small and medium sized enterprises through to PLC’s, charities and multi-national companies. Kate is CIPD qualified.

Peter Etherington MA, LLM, has worked in HR and Employment Law for the last 13 years and has a wide range of knowledge and experience in terms of HR practice and operational management, as well as employment law. His extensive experience enables Peter to gain credibility with employers and bring a pragmatic approach to people management solutions. This experience includes recruitment, disciplinary and grievance procedures, sickness absence, redundancy, TUPE, terms and conditions, contracts, management development, policy development, employment tribunal representation and resource planning.
