This course updates the law on advising and acting under a Lasting Power of Attorney and Court of Protection Practice and considers the pitfalls and problems encountered since commencement in October 2007.
The course will cover:
- Professional conduct issues on conflicts, undue influence and capacity
- Acting solely as the certificate provider - client care letters and charging
- What information do you need from the client and what questions should you ask to form your opinion as the certificate provider?
- The key advice that needs to be given and how to give it in a way clients understand
- Information that should be given to the Attorney
- Drafting problems and solutions
- Instructing the Doctor to complete the COP3 capacity certificate
- Drafting the application forms
- Serving the incapacitated person and others
