The Mental Capacity Act 2005 presents challenges for the professional advisor, as it creates a new way of working with individuals who are mentally compromised. There will be an expectation to work in partnership with the person in the decision making process and that the person will continue to be able to make those decisions they are able to make.
This course will consider how deputies, attorneys and others make decisions and the limits of their authority. It will cover:
- Orders from the Court of Protection
- Supervision and investigation by the Public Guardian
- The role of the Official Solicitor
- Interpretation of the Principles and their application
- Assessment of Capacity including acting as the certificate provider under Lasting Powers of Attorney
- Creation, registration and objectives to LPAs
- EPAs under the new regime
- The extent of the Deputy’s authority
- Welfare and medical decisions
- Advance decisions
- Protecting the individual
