Busy practitioners rely on the Standard Conditions of Sale or the Commercial Property Conditions (First or Second Editions) to provide the basis of a contract which is 'fit for purpose' for the sale of property with vacant possession or subject to leases (an 'investment property'). However, this requires a sound knowledge and understanding of the conditions, an awareness of the important differences between the three sets of conditions and an appreciation of where sales with vacant possession and sales subject to leases require different treatment.
This course provides an in depth analysis of the Conditions and will include:
- Passing of risk and insurance
- VAT (including TOGCs)
- Completion and undertakings
- Late completion and remedies
- Title issues and the contents of the transfer document
- Sales by public auction - avoiding the pitfalls
- Sales where Part 1 Landlord and Tenant Act 1985 applies
- Apportionment of income and outgoings
- Allocation of service charges
