Landlords with residential property portfolios face a range of regulations introduced in part by the Housing Act 2004. Case law is coming through now and reveals that private owners, landlords, leaseholders, tenants living in properties rent free and registered social landlords are all being hit by the changes.

Existing legislation relating to multi-occupancy, building regulations and disrepair appears to hold little sway over the Tribunals. Practice and procedure is gradually being established and some oddities are emerging - for example rent repayment orders where no conviction for lack of a license has occurred and some Tribunals are making decisions on matters not pleaded by either party. This course will look at emerging case law on a range of issues including:

  • Can your client avoid having a license to let property? Does a conviction stop them from being a fit and proper person?
  • When must landlords install double glazing, central heating and insulation?
  • What happens if tenants deny access to the landlord?
  • Can landlords be held accountable for works where tenants have exacerbated problems?
  • When are privately owned properties being taken over by local councils under Empty Dwelling Management Orders? How much effort do councils have to make to contact the owner before they take over private property?
  • Can the amount of rent reclaimed from unlicensed landlords be reduced?
  • How much can a council re-charge landlords for work and administration of the notice system?
  • Can a House in Multiple Occupation be split between floors that are non-contiguous?
  • When do Bed and Breakfasts become HMOs and require licenses?
