Course Overview Seminar

HMRC is beginning to flex its enforcement powers. That is bad news for many property practitioners who have not given this onerous tax the detailed consideration it needs. This practical course will guide and alert both commercial and residential conveyancers to the latent liability which can be so easily stored up if due diligence in the return and the extent of the retainer is not exercised.

The course will cover the following:

  • Why it isn't Stamp Duty and the risks you are storing up
  • SDLT treatment of residential transactions - flats, reversions, exchanges, subject to mortgages, RSL transactions, staircasing, building works, exemptions and reliefs for residential property
  • Risk points - linked transactions and connected parties
  • Are you storing up a nightmare of negligence claims?
  • Your obligations to the client and how to manage the risks
  • Do tax avoidance schemes work?
  • Commercial property transactions, business purchases, goodwill, consideration, sub-sales. options and overage nightmares. Reliefs and problems
  • Leasehold transactions - many unhappy returns? Who will do them?
