Intellectual property disputes are an increasing aspect of modern business life and this course aims to provide the commercial practitioners and litigators involved in advising clients in this area on the commercial factors and procedural steps to bear in mind when contemplating or engaged in such disputes.
Using practical and interactive case studies, the course will examine common IP dispute scenarios, such as the misuse of a company's confidential information and databases by ex-employees, import into the UK of products from overseas that infringe UK trade marks and design rights, and copyright and trade mark infringement in comparative advertising. It will cover, amongst other things, the following areas in relation to these scenarios:
- Assessing the IP rights involved and their ownership and validity
- Pre-action and interim relief, including interim injunctions, pre-action disclosure and Norwich Pharmacal orders
- Letters before action and threats
- Issue of proceedings and pleadings
- CPR and rules relating to the conduct of litigation
- Default and summary judgment
- Disclosure, witness statements and expert evidence
- Trial and post-trial issues
