The risks to the Will draftsman from an action in professional negligence are higher than ever. This course presents an opportunity to examine tricky areas in will drafting and to consider best practice and areas of particular risk. It also provides the opportunity to reconsider your precedents with a view to avoiding negligence claims.
The course will look at:
- Capacity: best practice; when it is safe not to make a will
- Foreign wills: when foreign lawyers are necessary
- Consideration of Inheritance (Provision for Family and Dependants) Act 1975: recent decisions; the duty of the will draftsman
- Undue influence and the role of the draftsman
- Drafting and tax considerations: use of the nil rate band discretionary trust
