Security over Land - Getting it Right

This course is suitable for commercial property and commercial practitioners who wish to improve their understanding of property mortgages and charges. Using a bank’s standard forms of commercial mortgage and mortgage debenture as illustrations, the course looks at how to ensure adequate protection for the security holder and maximum realisations on enforcement.

Issues covered include:

• Property included within the security – charges over land and mortgages or charges (fixed and floating) over other assets
• The ‘usual’ terms of a mortgage or charge
• Drafting effective enforcement provisions and understanding the remedies (including appointment of an LPA Receiver or an Administrator of a corporate borrower)
• Ensuring the security is not vulnerable to attack by an Insolvency Practitioner (undervalue transactions, preferences, financial assistance issues)
• Registration
