Course Overview Seminar

The importance of checking highway status for developer's lawyers cannot be overstated. This course offers a detailed insight into this complex area and looks at when is land 'highway land' and what is included within the definition, as well as wider issues including the impact of CROW and recent case law on village greens and common land.

The course will cover:

  • Formal dedication and s.38 Agreements, etc
  • Informal creation by public usage
  • Repairs and making up of private roads
  • Use of s.278 agreements
  • Highways and private rights of way distinguished
  • The new problems caused by CROW (Countryside and Rights of Way Act)
  • Village greens and common land - problems for developers and land owners
  • Footpaths, their status, and footpath diversion order
  • Stopping Up Orders and loss of 'highway' status generally
  • What you can and can't do on or over a highway
