This course is designed to give an update on the increasingly important area of domestic violence including recent developments and case law. Key areas covered are:

  • The Domestic Violence Crime and Victims Act 2004 and the implications for the family practitioner
  • Civil Remedies – Non-Molestation Orders, Occupation Orders and the ancillary provisions of undertakings and Power of Arrest. Committal Applications and enforcement procedures, including practical examples of applications and orders
  • Children and domestic violence. This section concentrates on implications in private law disputes although public law implications are also discussed
  • General interface with other relevant areas such as criminal law, housing and the local authority, human rights and the Protection from Harassment Act 1997
