Dealing with illness/disability dismissals present one of the most difficult problems faced by the practitioner. It is an area where employer clients are rarely satisfied since the solutions are often medium or even long term. Employee clients are often left feeling ignored and vulnerable. This course will review and update the law relating to illness dismissals (long and short-term) and disability. This will be done against the background of the practical needs of the client both employer and employee. The course will include:
- Illness dismissals - capability, conduct, SOSR
- The law of disability discrimination - and its practical application
- How illness (physical and mental) and disability rights interact
- Medical reports - their use and abuse
- The practical context; common problems and possible solutions
- Handling illness/disability so as to avoid a claim or promote defence to any claim
